This book analyses the war against drugs, violence in streets, schools and families, and mining conflicts in Latin America. It examines the nonviolent negotiations, human rights, peacebuilding and education, explores security in cyberspace and proposes to overcome xenophobia, white supremacy, sexism, and homophobia, where social inequality increases injustice and violence. During the past 40 years of the Latin American Council for Peace Research (CLAIP) regional conditions have worsened. Environmental justice was crucial in the recent peace process in Colombia, but also (...) in other countries, where indigenous people are losing their livelihood and identity. Since the end of the cold war, capitalism aggravated the life conditions of poor people. The neoliberal dismantling of the State reduced their rights and wellbeing in favour of enterprises. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. ¿Qué pasaría si, en el momento fundacional de la modernidad, el personaje principal no fuera el yo cartesiano, sino ese otro personaje que Descartes llamó genio maligno? Esa es la hipótesis que plantea el presente ensayo: ¿qué ocurriría si en lugar de la agotada certeza del yo, el mundo moderno se hubiera asentado más bien sobre la confusión y sobre la trampa que se condensan en la metáfora del genio maligno? The first issue of Artificial Intelligence and Law journal was published in 1992. This paper offers some commentaries on papers drawn from the Journal’s third decade. They indicate a major shift within Artificial Intelligence, both generally and in AI and Law: away from symbolic techniques to those based on Machine Learning approaches, especially those based on Natural Language texts rather than feature sets. Die mit dem Buch von Oswald Schwemmer vorgestellte Grundlegung etabliert Kulturphilosophie als eine systematisch organisierte Disziplin, und zwar als Ansatz für Forschungen, die auch über die geistigen Verhältnisse der Menschen ein empirisches Wissen bilden können. Angesichts der historischen Kontingenz und Vielfalt der verschiedenen Kulturen konzentriert sich die vorliegende Darstellung auf die - z. B. bildlichen und begriffli-chen - Medien, die als kollektiver Grundbestand die Formen der menschlichen Artikulation und Sinnbildung in einer Kultur prägen. Das Buch bietet eine Grundlegung auch (...) für Leser, die sich in den oft verwirrenden Disputen der Philosophie noch nicht verfangen haben. Eine Orientierung auf dem gedanklichen Weg dieser Grundlegung soll die Begriffskette Artikulation und Medium - Medium und Symbol - Symbol und Form - Form und Sinn - Sinn und Bild - Bild und Begriff - Begriff und Kultur geben, mit der die einzelnen Kapitel über ihre Titel zusammengehalten werden. Die Titelbegriffe stehen dabei für die Themenfelder, mit denen sich die Überlegungen in den jeweiligen Kapiteln auseinandersetzen. Diese Fokussierung auf ganze Themenfelder erlaubt es, in einigen Exkur-sen auch Um- oder Seitenwege in diesen Gebieten zu gehen. Dass die gedanklichen Wege dieser Grundlegung am Ende wieder zu ihrem Ausgangsbegriff Kultur zurückführen, zeigt, dass das Ende auch als ein neuer Anfang, nämlich zur Fortsetzung des Projektes einer medientheoretisch orientierten Kulturphilosophie gelesen werden kann. In diesem Aufsatz geht der Autor der Frage nach, ob und in wiefern die theologische Annahme, daß das Christusgeschehen paradigmatisch für den Begriff des Handeln Gottes ist, verständlich ist. Der Verfasser analysiert dafür die Geschichte der Leben-Jesu-Forschung und versucht die christologischen Konsequenzen der verschiedene Interpretationen für die Konstruktion eines Modells des Handeln Gottes herauszufinden. Er benützt Gedanken geschichtsphilosophischer Art um eine solche Ausdehnung der Vorstellung des Christusgeschehens zu verteidigen, daß auch andere Zeiten als das erste Jahrhundert einzuschließen sind. Damit zeigt (...) der Verfasser, daß Lessings Problem des garstigen Grabens und viele Formen der Leben-Jesu-Forschung theologisch von falschen Fragestellungen ausgehen. (shrink)

The pharmaceutical industry plays an increasingly dominant role in healthcare, raising concerns about “conflicts of interest” on the part of the medical professionals who interact with the industry. However, there is considerable disagreement over the extent to which COI is a problem and how it should be managed. Participants in debates about COI have become entrenched in their views, which is both unproductive and deeply confusing for the majority of medical professionals trying to work in an increasingly commercialized environment. We (...) used a modified meta-narrative review method to analyse debates about COI in the academic and grey literature. We found two Discourse Models: The Critical Discourse Model sees COI in health and biomedicine as a major problem that both can and should be addressed, while the Defensive Discourse Model argues that current efforts to control COIs are at best unnecessary and at worst harmful. Each model is underpinned by profoundly differing views about how society should be organized—in particular whether market forces should be encouraged or curtailed—and how the dangers associated with market forces should be managed. In order to make any headway, academics and policymakers must recognize that these debates are underpinned by profoundly differing worldviews. (shrink)

This paper is an exploration of the role of conscience in the justification of human rights. I argue that in both the western tradition of natural rights and the non-western traditions, human rights are justified, in part, because of their appeal to conscience, and not simply because they issue from a divine source or are based on reason. In contrast, contemporary justifications of human rights primarily look for an objective foundation or simply assert the pragmatic importance of human rights as (...) their justification. While there are distinct advantages to this way of arguing, there are also problems, which I will discuss. As an alternative, I outline Arendt's understanding of conscience as the ability to be with and think with one's self as a secular alternative to both a non-secular version of conscience, and the denial of conscience implicit in contemporary theories. Her view of political judgment helps us to understand how conscience can be understood as subjective but not arbitrary. This paper brings Arendt's insights on conscience and judgment to bear on contemporary discourses of human rights. (shrink)

Parental consent poses challenges to needed research with adolescents who identify as lesbian, gay, bisexual, transgender, queer and/or questioning (LGBTQ+) and are at heightened risk for negative health outcomes. Obtaining parental consent in studies focused on LGBTQ+ issues can prove arduous if adolescents have not yet disclosed their identity or have unsupportive guardians. Institutional Review Boards (IRBs) may be hesitant to grant waivers of parental consent, yet research suggests that studies requiring parental consent deter the participation of adolescents who identify (...) as LGBTQ+. In this article, ethical considerations regarding waivers of parental consent in the context of the American Psychological Association’s (APA) general ethical principles are reviewed and recommendations for psychological researchers seeking waivers of parental consent are offered. A vignette is used to demonstrate a question-and-answer guide to help determine if a waiver of parental consent is ethically justified. (shrink)

Are inequalities of income created by the free market just? In this book Serena Olsaretti examines two main arguments that justify those inequalities: the first claims that they are just because they are deserved, and the second claims that they are just because they are what free individuals are entitled to. Both these arguments purport to show, in different ways, that giving responsible individuals their due requires that free market inequalities in incomes be allowed. Olsaretti argues, however, that neither (...) argument is successful, and shows that when we examine closely the principle of desert and the notions of liberty and choice invoked by defenders of the free market, it appears that a conception of justice that would accommodate these notions, far from supporting free market inequalities, calls for their elimination. This book is a compact, accessible treatment of the main ideas advanced by the positivists, including Schlick, Carnap, Ayer, and the early Wittgenstein. Oswald Hanfling discusses such ideas as the 'verification principle' ('the meaning of this statement is the method of its verification') and the 'elimination of metaphysics, ' an attempt to show that metaphysical statements, for example about God, are unverifiable and therefore meaningless.

This book is a philosophical analysis of the ethical treatment of refugees and stateless people, a group of people who, though extremely important politically, have been greatly under theorized philosophically. The limited philosophical discussion of refugees by philosophers focuses narrowly on the question of whether or not we, as members of Western states, have moral obligations to admit refugees into our countries. This book reframes this debate and shows why it is important to think ethically about people who will never (...) be resettled and who live for prolonged periods outside of all political communities. Parekh shows why philosophers ought to be concerned with ethical norms that will help stateless people mitigate the harms of statelessness even while they remain formally excluded from states. Contemporary egalitarian theories of justice constrain the demands of equality by responsibility, and do not view as unjust inequalities that are traceable to individuals' choices. This paper argues that, in order to make non-arbitrary determinate judgements of responsibility, any theory of justice needs a principle of stakes , that is, an account of what consequences choices should have. The paper also argues that the principles of stakes seemingly presupposed by egalitarians are implausible, and that adopting alternative principles of stakes amounts (...) to fleshing out the demands of responsibility rather than imposing limits on them.
